Terms and Conditions of Use — Beatscape

1. General Information

Beatscape is a registered trademark of SM10 S.A.S., with NIT 901.278.565-1, domiciled in Colombia.

Access to and use of Beatscape's services, products, and digital platforms implies full acceptance of these Terms and Conditions.

If you do not agree with any of the sections presented here, we recommend that you refrain from using our services.

2. Definitions

• User: Any natural or legal person who accesses, browses, or uses the services offered by Beatscape.
• Services: Includes creative consulting, music advisory, soundscaping, music activations, and any other service related to brand musical identity.
• Content: Includes text, images, audio, trademarks, software, and any material published on Beatscape platforms.

3. Object

These terms govern the access, browsing, and use of Beatscape's digital platform, as well as the contracting conditions of the services offered.

4. Authorized Use

The user agrees to:

• Use the platform solely for lawful purposes and in accordance with Colombian legislation.
• Refrain from activities that threaten the security, integrity, or availability of the platform.
• Not use Beatscape's content for unauthorized commercial purposes or distribute it without prior written authorization.

5. Intellectual Property

• Beatscape and all its contents are owned by SM10 S.A.S. or hold the corresponding licenses for their use.
• The user acquires no intellectual property rights by using the platform or services.
• Any reproduction, distribution, or modification of the content without express written authorization from SM10 S.A.S. is prohibited.

6. Service Contracting

• Contracting Beatscape's services will be formalized through specific commercial agreements between the user and SM10 S.A.S.
• Delivery times, scope, and responsibilities will be defined in each specific contract.
• Beatscape may modify or update the offered services at any time, without prior notice, provided that signed contracts are not affected.

7. Liability

• Beatscape is not responsible for technical failures, platform unavailability, or indirect damages resulting from the use of its services.
• The user is responsible for their use of the music content and for ensuring that it is used under applicable legal terms.

8. Confidentiality

Beatscape is committed to maintaining the confidentiality of information shared by the user, unless disclosure is required by law or a competent authority.

9. Data Protection

The processing of users' personal data is carried out in accordance with Beatscape's Privacy Policy, available on our digital platform.

10. Applicable Law and Jurisdiction

• These Terms and Conditions are governed by the laws of the Republic of Colombia.
• Any controversy will be resolved by the competent courts of the city of Medellin, Colombia.
